You (or your attorney) can ask the Federal Police for a document that will allow you to re-enter, so long as you are only waiting for your card to arrive and have already been approved.

Hey, since you mentioned that you're just waiting for your RNE, i'd like to assume you're done with your PF appointment where you provided all documents for DN. If that's the case, you should have the Protocol. You just have to make sure you return here before your Protocol expires which has a normal validity of 3 months. Let us know if this is your case. Which appointment are you waiting for? The one to submit your application, give fingerprints, etc, or the one to collect the RNE?

That is contradictory in my experience. First appointment to submit application, give fingerprints, photos, confirm ID, etc; second appointment to receive the CRNM.

I do not see how you can have been approved without the first appointment.

Approval before formal identification, finger-printing, checking for criminal record, confirming finances, etc? That does not make sense to me, does it sound correct to you?

His first appointment? I agree - in which case he has not been approved....

Based on this information, he will not be allowed back into Brazil for 6 months, depending on his dates within Brazil. If he had already been through the first appointment, fingerprints, etc, AND been approved, then he should be able to get back in as there is a way to do that, even if waiting for the CRNM...

I would like to know if the attorney he used is an experienced and fully licensed ABA immigration attorney, that has charged a proper fee, or something else...? Initially it might appear he has been mislead?

@Peter Itamaraca my lawyer is great and its a firm that specializes in immigration.  the issue is getting this first appointment in santa catarina. like you said, without that i will have a hard time getting back in  she said its going to be an issue with the airline when i try to fly back  so shes working to try and get me this appointment before i go. 

If your concern is the airline requiring u to have a return back ticket when you return to brasil then u can just get a ticket out of brasil that s refundable, let s say sp to BA as an example

now if your concern is the immigration, i think your lawyer can do some documentation for u, they should know the process

The airline gate workers won't look at entry/exit stamps and count days.....heh. That's above their pay grade and you can imagine how it would slow down the boarding process.  All they will glance at is a valid visa page that isn't date expired.

You'll get flagged at immigration in Brasil and pulled aside, as the passport scan will trip you up.

Didn't know digital nomads had to to home for work though. First suspiscion the PF will probably have is are you legit on a DN visa.

The answer to both questions (airline and customs) is a document from the PF (protocolo), that will state that you can enter because you have applied for another visa, even though your tourism visa has expired. That is down to your immigration attorney now...

At this point, I would recommend that you and your lawyer walk into the PF office in Florianópolis together and explain your situation.  If you went in alone and were friendly and courteous you would probably get a hearing, but with your lawyer, it will be practically a sure thing.  There's really no downside.

Just to chime in, as they are applying for the DN Visa, which may be different from some other residencies. No contradiction: Digital Nomad application is made online, you upload all the documents and do not physically present (most of) them to the police at any time.

After the uploads, your criminal records, finances will be verified within a month or two, if there is anything missing, they will ask you to upload new ones. Then you will be approved, and your name will be published on the DOU (it's now official)

At your Policia Federal visit, only your passport, if its your first CRNM application your birth certificate (so they can put the parent names correctly on your card) and some other forms will be needed, and of course biometrics taken. No application documents will be checked there, they are not in the list of required documents to bring with you.

But you do sign a paper that says "If requested, I promise to present original documents within 5 years". Unless some really strange circumstances exist, I don't see how the officer there can decide to reject you at that point. The decision was already made. Also the start date of CRNM will also be the date of DOU, not the date of PF visit.

Whether "accepted" means you can already travel without a protocolo is another question, of course.
