Employer got rid of my passport

Hello, I am working on occupation permit here in mauritus.I need to visit my country and return back.But he suddenly changed rules, and saying I cant go back untill finish of contract

Hello,

Can you tell us precisely what you mean by 'got rid of my passport'?

You mean your employer was in possession of your passport and he lost it or threw it away?

Now, are you sure you are on an Occupation Permit or a 'Work Permit'? Vastly different schemes we are talking here.

I am on occupation permit and my employer was in possession of my passport and he is refusing to give it back

Why don't you get in touch with your Indian consulate here in Mauritius so that your employer is told that your passport is an INDIAN GOVERNMENT document and not a weapon to hold an employee hostage ?

Should you decide to break your employment contract , then the company could聽 go after you to be compensated for whatever expenses incurred to bring you to Mauritius.

NOTE: I am assuming that you are really here on an Occupation Permit and not on a work permit .

As External stated, your passport is the property of the Indian Government and it is illegal for your company to hold it.

Hi,
Please get in touch with Indian High Commission, LIC Building, Port Louis, immediately. Such employers should be black listed. You may speak with Mr. Sinha in the Indian High Commission about your issue.

I went to IHC and met Mr.D.k Sinha, he spoke to my employer.
Employer said he would return it.But when I came back to office,he threatened supreme court judge is his relative

This is very typical here. Everyone knows everyone (and in some occasion it might not be even true). I suggest that you keep Mr. Sinha in loop of all the proceedings. Worst case scenario, you can report that your passport has been stolen and file a fresh passport with Indian High Commission and travel with that new passport.
And in the meantime, let your employer be happy possessing a "stolen" reported passport.

What if he is asked for a police report wrt stolen passport?
and what would be the consequences if, in the end, it is proven he lied?

He should insist that the Indian govt via its diplomats ( that's part of their purpose and existence) does the right thing wrt its property. The Indian Passport is an Indian govt property after all. Whether the Indian govt get the EDB involved聽 will be up to them since the citizen is here on an occupation permit.
It is still strange that the employer did such a thing and it does raise some questions.

For passport stolen, of course, there has to be an official police complaint. And that is why I started with "worst case scenario". This particular case is indeed strange and I have heard such things happening in Middle East with unskilled workers working in the oil fields and that too many years ago. Now there are more strict laws and governance on the same.

Ideally, he should be in regular touch with Indian High Commission, since the document owner is the Indian Government and no one other than Indian Government has the rights to confiscate the government owned document. I think the employer for whatever reasons is trying to use "fear factor" to exploit the person concerned.
