Use of cleaning lady

Hello all:


I am using an independent cleaning lady in DR, whom I use after I or short-term rental guests leave. Is there a clear legal process in handling such arrangement? She is not employed staff, just hired on the job-to-job basis.聽 Are there formalities that I and she must abide?聽 I hear everyone has a different explanation.聽 Thank you in advance.聽

I am told some labor laws changed in 2022 that create more regulations, and local labor inspectors can be a real pain in the neck.聽 but it seems everyone i speak聽 with聽 has s聽 different聽 explanation聽 聽

And another thought....locals will want to consider themselves your "employee". That gives them certain rights. I hired a gardener to come by twice a month for a total of 8 hours a month, and guess what...he considers me his "employer".聽 They will also start asking for "incidentals" (i.e. my child is sick, I need money for medicine, etc). And advances on their pay. Its just how it is.

The laws did change and you could be at risk.聽 Cleaning staff and property staff can now be considered employees.聽 It used to be you could "contract" people.聽 They are contractors if they are registered with the tax department and give you a proper receipt.聽 You must retain a % of their contracted fee and remit it.


Or they are employees and have rights.聽

nezxt week and we are trying to whittle down what we are taking.聽 Hence, my question.


Do cleaning personnel that one hires provide their own brooms, mops, vacuum, etc.?


We will provide our own cleaning solutions.

Good quality brooms are hard to find here, and vacuums other than shop vacs are nearly impossible! I suggest bringing both if you are bringing in a container! We've had to ship in or bring in a couple of vacuums/dust busters. But even with a good vacuum, the Dominican way to clean floors is with a mop and lots and lots of water! 馃ぃ

You absolutely must teach any person in your house how to clean your way. I don't permit anyone to throw water around and I have had to teach them how to use a vacuum cleaner as well.聽 聽Remember anyone in this type of position is likely to have little education and little access to what you are used to.

What Planner says also goes for home repair. I normally provide tools,聽 ladders, and materials. They tend to show up on a pasola with no tools. And whether they know how to actually do what you ask them to do is another question.

there is a huge difference between what the govt says is the law and what is actually done on the street.聽 Gig workers are late, miss work, do a shi**y job, complain complain complain, break your stuff, steal, and then ask for severance when you don鈥檛 want them anymore?聽 Hah!聽 NO!

the govt has tried forever to implement labor laws for gig workers but fails over and over again. Why?聽 Cause the workforce sucks.聽 It鈥檚 not valued because it sucks.


聽 I tried to 鈥渇ormally鈥 hire my cleaning lady and that鈥檚 when she really got lazy.聽 She pretended she was pregnant and tried to extort me for money to get an abortion.聽 Need I say more?


if they want full benefits, like severance and health insurance, they should go work for a corporation with a job description, tasks, performance reviews, responsibilities, work hours.


if you鈥檙e a corporation, why are you on here, consult with your lawyer and have your cleaner registered under TSS.聽 If you鈥檙e a company then you better hire your people correctly.


there are ways your worker can screw you over IF the job they did went into an enterprise where money was made.聽 TALK TO YOUR ACCOUNTANT!聽 And know that the average Dominican is skirting the law but if you鈥檙e running a business you better try and do things right.聽 聽If you鈥檙e doing airbnb you鈥檙e probably not a registered DR business but you should be.聽 Your worker can demand rights and severance for example, if their work contributed to business earnings and you let them go for whatever reason.聽 They know this and with the right counsel, they could sue you.聽 And if they sniffed that you are making money?聽 Consider yourself a target.


If you鈥檙e not a corporation,,,, more often that not, your gig worker will still pressure you to think you鈥檙e their employer and therefore obligated to pay severance for example.聽 They鈥檙e actually right according to the law.聽 Yet meanwhile they were always late, broke stuff, borrowed money but never paid it back, etc.聽 聽Keep things clear since the beginning.聽 Allow them to decide if it suits them or not.聽 Don鈥檛 screw anyone over, but don鈥檛 be dumb either.
