VISA D - Family Reunification Applied from Abroad

jaaloukjoseph

Hello ! I received an Annex 46 and single permit for employment in Belgium. I am currently in Dubai with my spouse and 1-year-old child. We applied through VFS on March 23 for:

1. Visa D Single Permit (for me)

2. Visa D Family Reunification with Non-EU Temporary Residence Permit Art. 10bis (for spouse and child)

The application was forwarded to the Embassy in Abu Dhabi. We have now received an email stating our application has been forwarded to the Foreigners' Office (FPS Interior) for examination and decision, although on the Annex 46 it clearly mentioned that we were approved and that the Visa can be issued in Abu Dhabi.

Any Ideas how many weeks/months this might take ?

Usually, you should get within 1-2 weeks if you meet certain criteria like Gross salary, etc. but these days its kind of a black box and unfortunately no one can give a correct timeline. For some - weeks and for some - months. Good luck!

Hi, thanks for sharing your case.

I wanted to ask what exactly your Annex 46 mentions regarding family visas.

In my case, although I meet the fast-track eligibility conditions, my Annex 46 includes the following statement:

"Vous n鈥櫭猼es pas autoris茅 脿 d茅livrer d鈥檕ffice un visa D au conjoint et aux enfants mineurs du travailleur qui le demandent. Par cons茅quent, vous devez transmettre ces demandes 脿 l鈥橭ffice des 茅trangers pour d茅cision."

This seems to indicate that family visa applications must be forwarded to the Immigration Office instead of being issued directly.

Did your Annex 46 include a similar clause, or was it different in your case?

Thank you.

@RRao

Hello,

My annex 46 had this: "L鈥橭ffice des 茅trangers vous autorise 茅galement 脿 d茅livrer d鈥檕ffice un visa D au conjoint et aux enfants mineurs du

travailleur : voir conditions au verso." which i believe means that we were eligible for the fast-track and yet, I received an email stating that it has been forwarded to the Immigration Office.

This is very confusing because my starting date is in May and this is mentioned on my Visa application as well as my single-permit. Im really not sure why it has been forwarded to the Immigration Office and if this normal or not.

As far as I know, I have lost my fast-track benefit now. It is really confusing.

@dj68

Hello,

1-2 weeks in case they want to issue it from the Embassy right ? Once it is forwarded to the Immigration Office, it will take much longer ?

I am eligible for the fast-track and this is mentioned on my Annex 46/single permit and yet it has been forwarded I don't know why. Also any idea after how many days it will appear on the Visa Follow up Tracker ? Thank you for the help

Thanks for sharing 鈥 that helps.

Your Annex 46 allows direct issuance for family visas (fast-track), while mine explicitly requires them to be forwarded, so fast-track doesn鈥檛 apply in my case.

That鈥檚 why your situation is surprising 鈥 even with fast-track, your file was still sent to the Immigration Office.

From what I understand, this can still happen if additional checks are needed (e.g. income, housing, or relationship proof), or if not all conditions are clearly met at submission. Guidelines also say direct issuance is only possible when all conditions are met; otherwise, it must be forwarded .

Also, since your Annex mentions 鈥渧oir conditions au verso,鈥 it might be worth checking the conditions on the back side 鈥 there could be specific requirements that triggered the referral.

Hope it gets resolved quickly given your timeline.

@RRao

Hi again.

I believe that whenever there is a certain doubt related to any of the documents in the application, the Embassy always tend to forward the file to the Immigration Office just to be on the safe side. At least this is what I understood from all the researches I've done online.

To be honest, I did not bother and ask the Embassy about the exact reason why they forwarded my application to the Immigration Office because they mentioned in the email not to contact them in case I have any questions related to my file. I'm not sure if it's worth to try and ask them honestly.

Now my main concern is the following: Since I was already eligible for the fast track, does this help in making the process in the Immigration Office faster or it doesn't really matter ? Will my application now take anywhere between 2 to 9 months to be issued from the Immigration Office or not ?

I don't know honestly who has all these answers but I think it's worth asking. And btw, my application has been forwarded 2 days ago now, and yet nothing shows on the DOFI website when I try to track it !

In case you got new answers, would appreciate it if you share them here. Will do the same.

Have a nice day !
