Family visa appeal to refusal
Is anyone did appeal to family reunion visa refusal and get positive answer? Please share your experience. Today I found on dofi.ibz.be. my visa status changed into WEIGERING/Refusal after 6months waiting.
My husband has been living in Belgium for 17 years. He had got 5years of B card when i started applying. A week ago he has got belgian nationality.

It's completely different from the mutuelle. The mutuelle is only when you will have the resident card.
And so long you aren't covered and fully registered by Belgium administration, you have to keep it.

If the certificate of the insurance states the date of the coverage period from the day of her arrival, then your wife may not need an additional insurance.
The rule is simple. If your wife reports to the commune within 8 days of her arrival, you can always ask the commune personally. If the staff said that she needs additional insurance coverage, you can buy it online or through your insurance company and submit it later.
In some cities, the commune asks for the health insurance immediately whereas, in some other administrative offices, the person applying for family reunion submit it a few months later when the commune asks for it.

Can someone please suggest a way forward for my issue.
My wife is in India and am in Belgium,to process dependent visa I get to know that BC is mandatory.
The issue here is her DOB in BC is Xx-YY-1984 and in passport and all other documents it is XX-YY-1983. As birth certificate is mandatory and they compare it against passport ,I feel it will lead to confusion and rejection.
We couldn't correct the dob in passport ,as there is a government rule to not to change dob for the passport that has been issued 5 years back.
Can someone help here on this please.

I am from India, my family reunion visa got rejected after 6 months of waiting period. I haven't received the letter yet from vfs but, i got to know through the not-positive message and checking through the dofi website. I am thinking of a re appeal. Do you know if any of your friends went through such experience?
what is the procedure to re appeal and how long does it takes to have the result? Can we do it via mail or should we go to vfs to submit the remonstration letter?

99% of the time, the visa refusal is due to a poorly prepared file. Therefore, first wait for the official document stating the reasons for the refusal. Then rectify the errors and represent it again.

I completely agree..I am not in favour of the idea to go to the lawyer as well. firstly, costs a lot of money.Secondly, i dont know how long it would take if we go via court.
I gave a call to the immigration dpt, they informed that it is only possible to reappeal via the court of Brussels through a lawyer..Not sure if this is the only way exists
I would be much relieved if i can send a letter to the embassy or a mail or even in person...Do you have any idea how it works?
Another approach: Wait for the rejection letter, understand what is the reason of rejection (what document was missing that could not prove what point) and re-apply with a more solid file/paperwork.

Your husband needs to go on his mutualiteit and get insurance for you under his name. It is different from the travel insurance. May I know from which country you are?
I’d applied short stay family visit visa for Belgium from UAE, as I’m employed here in an digital agency and working as a computer engineer.
My sister and her family lives in Belgium and they recently got Belgiun passport as well, so my brother in law sent me invitation letter.
Visa submitted: 28 Jan 2019
Visa sent to immigration: 6 February 2019
Visa rejected: 09 April 2019.
I’ve not got the refusal letter yet, just saw it on dofi website. It’s one of the most sad day of my life as I was not expecting the refusal.
My intended date of visit was 5th to 14th April, can it be the reason as the date was passed when they took the decision?

If your visa was accepted, you could have picked the dates you wanted to travel (in a 3 months range) with the exact number of days you did request in your application.
They'll either give you a valid reason (missing papers/money) or a lame reason if the file was good looking.
Visa C of type "Family Visit" is pretty hard to have. Immigration only thinks people will never go back to their country, even if they might be honest.
First of all thanks for your response, much appreciate that.
So the reasons they mentioned are three,
1- We are not sure of your relationship with invitee ( don’t know what kind of proofs I can give, I’d attached belgium id of my real sister living there)
2- we are not sure if you will come back ( I’m living and working in UAE, i’d Attached NOC of my company where I’m working, also the tenancy contract of the home where I’m living in, also the visa copies of my wife and daughter who r living here in Dubai with me)
3- Not enough funds (in visa application they mentioned that you should have 55 euro per day of your stay, I almost had 20 times more than that in my account of the desired duration, plus salary certificate which shows quite hefty salary amount)
Don’t know if I should go for appeal.

1) Did you show a certificate of birth that proof you and your sister have the same parents?
Did you proof you share the same blood and are related together? (family book, certificate of birth (you and your sister + name of your parents on it), any legal paper that proof your relationship, ...)
2) It's the default deny reason for family visit visa. They just want to say: hey, go away, we don't want to see you in Belgium. (sorry to be rude, but that's the real message they want to spread...).
99% of the case, it's because you don't show enough money / pay slips / bank history / tie in your country, ...
3) What paper did you gave them? At least 3 months bank history? (with enough money on your bank account???) Contract? Pay slips? What about the salary? (1400€+ and more????)
What did you write in your cover letter to explain that you'll go back home no matter what? (job/family tie/house/car/.... everything that has some value that will make you come back home no matter what, ...)
Sponsor from your sister/brother-in-law might help you... (annexe 3bis paper at hometown if they earn enough money per month +/- 1500€)
Sorry to tell you that, but appeal is completely useless... really...
It takes from 2 years to 3 to see the judge... You'll see your sister before that.... (well I hope so...)
The immigration in Belgium is playing with the long delay from our glorious justice, to give fake/useless reasons to deny peoples (they're force to give reasons by European's laws no matter what in case of deny), knowing they're sometime wrong, but no one will go for appeal, as it takes too much time for a stupid tourist visa...
Based on the reason on your denial, I'm 99,999999999% sure that you've no stamp from the immigration of any OECD country in your passport / never any stamp in it.
So, you might REALLY consider to get a visa from any OECD country first (Mexico, South Korea, Japan, USA, ....), then go to Europe to see your sister.
I'm sure it's not what you wanted to read, but that's reality...
By going to any OECD country, you'll proof your integrity and that you can be trusted (and that you'll always come back to your country).
My girlfriend was denial +/- 1 year ago because she couldn't proof the link to her family in her country of origin. (We gave them certificate of residence that her father/mother/brother where living at the exact same address as her)....
They just decided to ignore it and give false reasons... "Thanks for the fee, ask again, but now we don't want to see you."
I still have a mail of the consult of Belgium, from where she applied, apologizing against such stupid lame reasons................ (embassy have no real power in case of denial from immigration)
