After having gone through all the paperwork, I am giving answer to myself. Yes, it is able to apply for residence permit B as soon as 5-year working criteria is met no matter current A permit is still valid or not.

I鈥檓 staying in Belgium for聽 past 5 years, and I have valid 6 work permits (continues without any break), latest work permit expires on dec 28,2018. I applied for B cArd in September, 2018 and commune have sent my file to ministry. I haven鈥檛 got any confirmation from ministry on my file.

I haven鈥檛 applied for work permit again thinking since I already completed 5 years I will get B card. My RP will expire in jan 2019. Now I wonder should I apply work permit just in case!

Any advice??

Your approval will come by end of your current RP I believe. Do consult your employer and commune for confirmation(if you need to apply another wp).

Thanks Aneesh.

I went to commune and they told me apply for work permit irrespective of decision on B-Card.

Now, my situation is as follows,

1. Work permit is getting expired on 28-Dec-2018, and my employer will apply for work permit on 2/3 jan 2019.
2. Since my resident permit getting expired on 28-Jan-2019, commune told me I can stay till then.

my worry is, if B-Card decision is negative and since my employer is applying for work permit on 2/3 Jan for extension, not sure how much time it will take to get the approval! and if the approval comes after my resident card expiry(29-Jan-2019), what should I do? continue to stay? since I have applied for new work permit?

I'm really聽 scared of my situation, not sure what to do!

For others,

Work permit is very very important! irrespective of you applied for B-Card or not, always apply for work permit. I made a mistake(my company also!) of not applying thinking that since I have applied for B-Card it will be take care!

Very true. Till your residence permit type B is not in your hand, you need a work permit to be legally working here. Now, I am pretty sure your long term resident card (rp type b) will be approved by end of your current rp.

If that doesn鈥檛 happen. I am not sure of the legalities

The commune verified Originals along with photocopies, so you need original copies for verification purpose, of course it depends on commune to commune.

Luckily I got my BCard approved! My feeling is if your resident card is valid and you have applied for B-Card extension 3/4 months prior then you should get your approval!

Is there anyone who switched from A card to B card via "automatic process"?
When you apply for the new A card, they approve B card automatically after 5th year.
This is what they say. Is there anyone who experienced that?

I have been studying with for 5 years in Belgium , till masters level and living at the address with my family who are citizens of Belgium ( sister, brother in-law, and their three kids) and been doing some student jobs under permit c as international student. so being a non-EU individual, so do i qualify for PR and which one.

The reason why am asking is that i have approached by many recruiters interested in my聽 specialty and knowledge via my linkedin聽 but only have permit C.

Hi Ttush5,

As you pointed out, you were on student status. So you are not in order for the work permit or for the resident visa. So via a Belgian potential employer, you will prepare a complete file for that.

That's what Districthuis in Antwerp is saying. They say, apply for the new A card, then Brussels will automatically issue B card if you have filled 5 years in Belgium.

Nowadays they tell everyone same. That's why I am wondering if anyone has done like this and got B card approved.

I applied for my card B on October 2018 and i am still waiting for the reply. Did you follow any process? I mean did you call ministry? or pushed commune by approaching them again and again? or used any lawyer? or was it automatically approved?

No, A card would be issued by default. You have to explicitly request for B card. The civil servant there will do something with their system and submit the request in front of you.

hi all,

I'm from NON EU, work (on assignment) and live already 4,5 years in Belgium in Flandria region.
I'm considering now to move to Brussels. Should I expect any issues with obtaining long term residence later on because of the changing of the province?

So far, I learned that sometimes Belgian provinces acts completely independent from each other

No. the ministry looks only at the date on which your first RP was issued and counts 5 years from that. Your area of residence has no impact on this.

Hi,
I also completed my five years of residence in Belgium, not sure if the five years is completed for My residence card. I came in June,2013 and I have applied my B card in July,2019.
Can there be any problem if B card is applied some time聽 before the residence card 5 years ? May be 5 years through card get completed next month or so.

Hi everyone,

I just got approved of SingPermit, and got a three-year long term residency (B card). They say that these two things will be in one card now.

The thing is this work permit is only valid with my current firm. If I want to change to another firm with my B card, do I need a new work permit or not?

Yes, you need a new work authorization. As you already have a RP, they will just update the employment details in that I assume. Your new employer will have a clear official answer on this.

Interesting thread.

If I have an indefinite contract with my Belgian employer, can they apply for my work permit B for longer than 1 year duration.

I have few Indian colleagues in ING for whom since 2019, this process has been implemented. They are still not eligible for Work permit type A.

I did not find any information for this on internet so thought to check on this forum.

I don't know about Brussels and Wallonie but in Flander, they started issuing 3-year work permit type B since the beginning of 2019.

As far as I remember you only can get type A if you have been working with type B for at least 4 year (3 year if you live together with your spouse) and your work permit type B does not belong to high-skill worker category. Normally, people would rely on type B permit for 5 year and then apply for permanent residence permit which allows them to stay in Belgium indefinitely and work without permit.

Concerning 3 yrs working permit.

My HR informed me that there is no place or mention in the form where they can apply for a 3 year long Single permit.

As I have a indefinite contract they wanted to do so but they could not find any option in the application form.

Can someone let me know how can I explain this to my HR team.

For the long term residence permit (5 years), does the criteria of 5 years of stay consider stay (residence) in other EU countries? for e.g. i stayed in UK for 1.5 years before moving to Belgium. Will that be included in total timeline ? or is it specific to total stay in Belgium only?

Be logic...

What do you want Belgium to do with the time you spent in another European country? It's your business. A residence permit is granted to a person to reside in his country. Not in another ...

After 4 years on WP B, there is a possibility to聽 apply for WP A, I believe. Exact details -- Labor ministry website (of the region you work) has all the info you need. Now with the single permit, things may have changed. Consult your commune.

Hi Aneesh,

Your answer is partially right. In fact, it's a bit more tricky...

The authorization of unlimited duration is granted to foreign nationals who have worked for at least four years under a work permit B / work permit for a fixed period during a period of not more than ten years of uninterrupted legal residence in Belgium immediately preceding the application for a fixed-term work permit.

In some cases, this four-year work period may be shortened by one year if the country of those foreign nationals is bound to Belgium by an international convention or agreement (Serbia, Macedonia, Kosovo, Bosnia and Herzegovina, Montenegro, Turkey, Morocco, Algeria, Tunisia).

These time limits can be further reduced by one year if the spouse or children of these foreign nationals legally stay with them in Belgium.

Years of work covered by work permits or work permits granted to non-EU nationals who are bound by an employment contract with an employer or to non-EU nationals who are not related to work are not taken into account. their employer by an employment contract in accordance with Belgian regulations.
