Pacs France

marcozeke

Hi everyone,

I鈥檓 looking for advice from Americans who have already done a PACS in France with a French partner, or anyone who really knows the process well.

I am American and planning to PACS with my French partner soon, but we鈥檙e getting conflicting information from different sources (mairie, French websites, embassy, etc.), so I would like real feedback from people who actually went through it.

Hi and welcome to the forum 馃檪

The PACS process can indeed be confusing, especially since each mairie may handle it a bit differently. Is there a particular area or step where you鈥檙e looking for clarity ? For example, documents, translation, or eligibility requirements?

That鈥檒l help members who鈥檝e gone through it share more precise advice.

regards

Hi Bhavna, thanks for your reply 鈥 and sorry if my question was a bit long or confusing.

I will try to be more specific so that others who have gone through a PACS between an American and a French citizen can help.

I have a few questions because the official French websites are unclear and I鈥檓 getting different answers from different mairies.

鉂 My questions:

聽 聽 1.聽 聽 U.S. Birth Certificate

My partner is American and was born in Harbor City, California.

Can he simply order his U.S. birth certificate online (for example via VitalChek) and present it to the mairie in France as is?

Or does it absolutely need:

聽 聽 鈥⒙ 聽 an apostille from the California Secretary of State

聽 聽 鈥⒙ 聽 AND a certified (sworn) translation into French done by a translator accredited in France?

聽 聽 2.聽 聽 Document about marital status (single status / no PACS / no marriage)

In France, they ask for a 鈥渄ocument unique鈥 which includes:

聽 聽 鈥⒙ 聽 certificate of no marriage

聽 聽 鈥⒙ 聽 certificate of no PACS

聽 聽 鈥⒙ 聽 certificate of no registration in the French civil registry

But since these documents do not exist in the U.S., does my American partner still need to provide this document?

If yes, how did other Americans do it?

聽 聽 3.聽 聽 Certificat de coutume (or equivalent)

The U.S. does not issue a certificat de coutume.

From what I understand, Americans must go to the U.S. Embassy in Paris and request an 鈥渁ffidavit in lieu of certificat de coutume鈥.

鈫 Is this correct?

鈫 Did anyone here do this step?

鈫 Is the affidavit from the U.S. Embassy enough for the mairie?

聽 聽 4.聽 聽 Interpreter requirement

The mairie told us that because my partner does not fully understand French, we must hire a court-certified interpreter (asserment茅) for the PACS appointment.

Is this also what other couples had to do?

Any recommendations for a sworn English鈥揊rench interpreter in Paris?

Any help from Americans who have successfully PACSed in France recently would be really appreciated 馃檹.

We just want to be sure we follow the correct process before booking flights and appointments.

Thanks a lot
