EP rejected and need help to understand the rejection reason.

alezander12

Hi Shekhz & Beppi,

Been here for a while and shared my application process once in another post last month.

Unfornaturely, My EP application got rejected by MoM last Friday.

The reason is below:

"It is not common for companies to employ candidates with similar credentials at your declared salary. We need to ensure that you will be paying the salary and be convinced that the salary for the candidates is justified, especially, if there has been a significant change from the past salary drawn.  For renewals, please show us proof of the actual salary paid to the candidate in the last 3 months. it will help your case if you can submit documents to show your company has the finances or other means to sustain your business operations, including your employee's salaries."

My situation is below to provide a holistic picture for your reference:
Position: Senior Manager Position
Salary: SGD 8000 - 10,000 per month
Exp: around 10yrs
Industry: Fund Management
Education background: LLM from UNSW and Bachelor of Applied Finance from Macquaire University. (both Australian universities)
Professional Designation: CFA charter holder
Nationality: Australian

It would be much appreciated if you could answer the following questions:

1. Does MoM think the declared salary is too high or too low for the position I am applying for?
2. Does MoM worried Source of Fund for the company? and is this the key issue?
3. The context "For renewals,......"  does this relevant to my appeal application? or is it just a reference for me to renewal my EP in the future? (although I just got rejected for my ep application in the first place).
4. Any other thoughts/ suggestions

At last, the company that lodged the EP application is owned by me (100%).  the company is also in the progress of getting a license from the Monetary Authority of Singapore.  the company has a registered capital of SGD 100(but upon the grant of the license, I will have to inject additional capital and make the total number goes above 250K SGD) and has a local staff on the payroll.

Much appreciated your help and support.

Regards,

I will try to answer your questions as follows:
1. Obviously, they think it is too high.
2. Clearly, they are asking for proof that the company can pay your salary. Whether that is the only issue? See below.
3. This is a standard phrase. The part "For renewals, ..." does not apply to you.

Here we have the real issue: The intended visa type for this situation is the EntrePass, not EP!
While the "EP in one's own company" loophole has still not been entirely closed, it has become more and more difficult in recent years to achieve this. Unless yours is a business Singapore covets (which seems unlikely, given the reply you received) they will apply similar criteria on your EP as on an EntrePass.
I recommend you engage a reputed business incorporation service provider (not the cheapo types who claim they can also do this!) to help you assess the chances and develop a strategy. Or you hire a local professional manager instead of moving here yourself (That is what MoM actually wants!).

hi beppi.
my case is different i use to work in singapore and my salary was 8000 and now my employer applý for me not my own company.mom want to proof of my employer can pay this salary or not.i have 7 years experience in singapore.this is not my own company .i use to get 8000 salary when i was in singapore.how can solve it and how can convince mom i will get 8000 when i work in singapore in this new company

beppi

First you write your situation is the same, now it is different again!
If MoM doubts that the employer can and will pay the offered salary, it‘s their responsibility to convince them otherwise (e.g. by showing what financial benefit you will bring to them).

rezarahimi834

can you help me what my employer have to show mom.what is good.please advice me.

rezarahimi834

what is good thing to show mom.how convince mom they will salary 8000 to me.as i told you my ex company paid me 8000 when i was in singapore.

beppi

The employer should submit the information and documents MoM requests - they should show that they can and will pay the offered salary and that the benefits of hiring you at that price outweigh the cost.

Shekhz

Unaudited financial statements showing cash inflows to pay salaries and other operating costs is what needs to be provided to MoM as supporting documents.
