Problem with trees

Just askin

Hi guys has anyone had a similar experience as me regarding high trees near our property..I live out in the sticks a bit in just above Central Thailand.. Moved in here 4 years ago a piece  of. Land at the back of the house quite large has hundreds of trees.. Now theses trees not only overhang our garden but are actually on our roof.. Our gutter and downpipe is completely blocked.. Gutter broken is some area beyond repair.. Im not talking about 1 or 2 branches there are actual trees over the wall.. We contacted the boss man of the village 2 years ago been back 3 times  nothing done doesn't want to know about this also more important the trees are high very high Ive seen them bending towards the house in the wind  I expressed my fears about my children's bed room being near the wall. He said doesn't know who owns it Yep.. And then said in the next breath the Ower not in country Yep.. Nothing I can do he saidi its at the point I must get this repaired but it will only be the same again in a few months if nothing g is done. Its causing arguments with my wife over this as she just bends to authority as most thais do. I know this whole thing is corrupt.. Do I rock the apple cart in the village where I live or do I speak up and possibly cause friction.. Any helpful answers appreciated.. If you've had similar I'd like to know..

Sorry, have you posted in the wrong forum? This is the Italy forum, and you are saying you are in Central Thailand.

Your profile also says you are from Thailand and looking for information about England.

Never done that

We have same problem for 10 years.

I choose to cut everything over the wall, hang into our ground, on our roof.

I have to buy a Telescopic tree cutter (8 meters i think it is), With a saw at the top.

With that it was "Easy" to cut everything.

Then last year, The empty ground behind our wall have people working on it.

I go talk to them, And told them about the tree and our house, our roof and so on.'

And ask them to cut the tree a bit more to help out.

When i return +1 hour later, They have remove the whole tree. :-)

You can take picture of the problem, The damage.

Go to you Amphoe / Thetsaban and make a complain.

If they find it to be a problem, They come and look at it.

And if they agreed with you, They going to help out and make the owner clear it.

Kindly.

@Never done that

Thanks mate went to the office took photos of damage to roof gutter wall ect all caused by the trees.. They called us yesterday to go back they had a large file prepared But said at the moment nothing can be done the owner of the land is  not from thailand Ann cannot trace him So I said then it is the responsibility of the council to make the land safe But the boss said cannot cut without permission from the owner Just knocking my head against a brick wall

I can't cut They Won't cut Seems everyone is afraid to make a commitment perhaps the land is owned by a Certain person eh..

Never done that

For me, like i say.

I cut everything for years inside my land, I dont care about the owner. It is our land, House.

I speak to the people working on the land to cut it, NOT the owner, And they remove it.

I dont have any idea if they contact owner, But i doubt it, As they start removing it right away.

No idea why they dont cut it for you.

Here at our Soi, years back, people was told to cut the trees that was up in the cable, Or else !!

People did not do it, And our Thetsaban send people to do it.

People here smil and was happy that the Thetsaban did it.

BUT a few weeks later when the bill come to them, That smile was gone fast :-)

And no one skip cutting them now when Thetsaban say it is time again :-)

But you have to do what you think it is best.

I know i never let tress damage our house.

And can see everyone else (Thai) are doing the same thing as i did.

Kindly.

That sounds incredibly frustrating, and I totally feel your pain. The struggle between 'not causing friction' and protecting your family’s safety is a classic expat dilemma here.

In my experience living and working in Bangkok, I've seen that the 'Village Headman' (Phu Yai Ban) often avoids conflict unless it’s made into a formal issue. If the trees are physically damaging your property and posing a danger to your children’s room, you actually have legal grounds under the Thai Civil and Commercial Code (Section 1347). It specifically says that if branches overhang your land, you can ask the owner to cut them, and if they don't, you can do it yourself and even charge them.

However, since the owner is 'out of the country,' here is what I’d suggest to keep the peace with your wife and the village:

Document everything: Take photos of the broken gutters and the trees over the roof.

The 'Soft' Legal Route: Go to the local Damrongdharma Center (it’s a government complaint center found in every district). They are great at mediating these 'village' disputes without it becoming a full-blown police matter.

Safety first: If the Phu Yai Ban won't help, maybe suggest to your wife that you hire a local crew to cut ONLY the branches overhanging your wall. It’s a middle ground — you protect the house, but you aren't 'attacking' the neighbor's land.

It’s a tough spot to be in, but don't let it ruin the peace in your home. Friction with neighbors is temporary, but a tree through the roof is much worse! Good luck.
