How to obtain work permit for UK National at the moment

Hi folks, hoping for some advice here. I work for a global company and we are planning to employ a UK National for a specialist role at our Rep office in HCMC. We therefore need to obtain a Vietnam work permit for him. However the legal advice we are receiving is that he physically needs to be in Vietnam whilst his work permit is applied for (he is in the UK at the moment).

Clearly just based on travel restrictions, this is not feasible at the moment, plus it鈥檚 not reasonable for him to resign from his current role in the UK and travel to Vietnam speculatively without confirmation of his work permit first.

Does anyone have any similar experience or any views on this legal advice that he needs to be in Vietnam whilst his permit is applied for? This makes little sense to me and I鈥檓 not sure about the accuracy of this legal advice.

My wife works in HR for a multi-national company and said you can apply for a work permit whilst the employee is not in Viet Nam. You may want to try another legal firm.

For Ho Chi Minh City, a Vietnam work permit can be obtained if your specialist is not in Vietnam. However, he/she needs to send his/her physical passport and other required documents to Vietnam for work permit application.
