There is no 5 years residency condition to apply for unlimited work permit. I got my approval after having 24 months paylsips (im turkish and have my wife here with me) and i had 25 months in Belgium at that time. Since you will have a valid contract at the time you will be eligiable for a Indefinite work permit, you will not have a problem i thing. Permit itself will be granted within 4 weeks and then you will receive a year long residency permit. As soon as you recieve your ind. work permit, you will be able to start working for someone else.

You don't need 4 years. Now you can apply after 30 months of work. They changed it last year. I just got my unlimited single permit  this month and I applied after 30 months.

Now law has been changed. Now you 30 months pay slips to apply for Unlimited single permit.

It is for Brussels region only, if I am not mistaken. if the person if from Brussels region, that yes, 30 months

Umut, conditions for unlimited single permit are different. This is depend on nationality,region and so on.


There is an exception for Turkish citizens in Flanders region ( this deducted to 2 years for married and-or has dependent and 3 years to single ones) If i am not wrong Tunisians should have this expectation too but not sure. So this not means everyone else could have same condition for it.


However this condition is different in Brussels . 30 months.

Hi all, I applied on 15/12 and today I received a positive decision, they say it's now with the office des etrangers for their decision on the residency. However, on the new work permit, it's saying that the worker cannot work until a final decision on the residency is taken by the office des etrangers. I still have a valid residency permit until May 31st.

That is for very first work permit only. When you have changed your existing and valid work permit into the indefinite period, you can keep working as long as you have a valid residency permit. Now, you will have a new residency permit, which needs to be renewed every year once its approved.

so this means I will have to renew every year my residence card? meaning it will always go to OE for approval every year also? or is it the commune who can deliver the card without any approvals?

As per my experience, it goes via OE for renewal.

yes, you will have to renew it every year through the commune. even though you have a permanent work permit, your RP extension application will take weeks to get. I suggest you to apply 3 months prior your expiry date.

Guys help! I'm confused. Like I mentioned earlier, I got my unlimited work permit and it says the file will go automatically to OE for approval. However, on the dofi.ibz.be website, it mentions that I should take appointment with the commune to get the RP part started. I sent a mail to the commune and all they said was to check with dofi website 🙄 anyone knows how the first time goes?

Is it the first time that you've applied for an unlimited work permit?


If yes, the first time exactly looks like a normal Single Permit, and you go through the same procedure. Once you receive positive feedback on your work permit, the immigration office checks your residence and issues you an approval, by which your commune sends you a letter or arranges an appointment with you (or no appointment is needed and you can go there directly).


If this is not the first time, you only need to go to the commune and ask for an extension with the documents they request.

Hi, yes it's my first time. My understanding it goes straight to OE and they will send me a mail with a copy to the commune, and then the normal process with the commune for the card. But, what confused me is that the dofi website is not very clear, and even the commune came back to me with a strange reply when I sent them a mail. I took an appointment in the commune but only in March, I hope I will receive a feedback earlier.

as Mehrdad has also mentioned, for the first time application it is exactly the same procedure as single permit. Once your residency permit is granted, you will be informed. Then you will need to make an appointment via commune to ask your new ID.

Has anyone applied for RP extension after 1 year of obtaining the indefinite work permit so far ? If so, how long does it take to get the extension ? I mean the processing time

I applied for extension + for L card simultaneously. Got L card 3.5 months after my A expired. Did not get anything for A extension so far.

I have applied for renewal of my  RP based on unlimited work permit but It has been 3 months and there is no response.


Is it possible I can visit netherland IF my RP is already expired.

Legally, if your RP expires, you’re not allowed to leave Belgium.

Edited, sorry for misinfo - difficult morning :) :  I applied for A extension 3 months in advance + for L card simultaneously. Got L card in 3.5 months timeline, a week after my A expired. Did not get anything for A extension so far. - @gannam
