New fine for overstaying ?

A friend of mine has left Brazil yesterday evening, he was here on a tourist visa. He has been staying in Brazil for the last 20 years on consecutive tourist visas, before Covid he was able to stay 180 days at a time, and since Covid he can only stay two times聽 90 days per year, and he has to leave Brazil for 30 days between these two periods.

I guess he didn鈥檛 take into consideration how they count your 180 days (he probably came back to Brazil few weeks too early), so they handed him a fine for an overstay of 19 days, however the the fine is only 475 Reais, which corresponds to 25 Reais per day.

He had a similar situation a few years ago, just after Covid, and back then he had to pay a fine of 100 Reais per day.

Does anybody know if 25 Reais is officially the new fine for overstaying?

I can't find any sign that the fine has been lowered from R$100/day.聽 The immigration agent has considerable discretion, though, and may have exercised it on your friend's behalf.


Whether a traveler qualifies during any twelve month period for two consecutive 90 day stays connected by a renewal or two separate stays of 90 days each depends on how each country is classified on the QGRV, which generally depends on the terms that the country extends to Brazilian travelers.聽 Most Schengen Area countries are on the two separate 90 day stays regime, indicated by an asterisk (*) on the QGRV.聽 This can change periodically, so it's important to check the latest QGRV, which should be available here:



If the Portuguese and English versions differ, best to treat the Portuguese as authoritative.

I haven鈥檛 yet received an answer from him, but I suspect he might have told the immigration officer that he was going home for the funeral of his mother (she was 92 and in the hospital, so it wasn鈥檛 totally unexpected. Plus, he actually had planned to stay until June 17, meaning that if she hadn鈥檛 passed away, he would have overstayed even longer. But I鈥檓 sure he was smart enough to not tell the immigration officer this). I can see that if he mentioned the funeral of his mother, the immigration officer applied the lowest possible fine. Or maybe he just got lucky and they took into consideration that in over two decades, he only had had one overstay during Covid.


As for 180 days vs 2 times 90 days, I personally haven鈥檛 come to Brazil before Covid, but from what my friend told me, he could easily renew his tourist visa every year, during 2 decades, simply by going to the Federal Police (at the airport in Salvador), and he never had a problem. Since Covid, this is no longer possible. Switzerland isn鈥檛 a member of the European Union, but it has signed the Schengen treaty, so my guess is that the 2 times 90 days rule (with 30 days outside of Brazil between these two periods) is the same for every member of the Schengen treaty.

Most, but not all, Schengen countries are on the two separate 90 day visit regime.聽 These Schengen countries (including non-EU members that are part of the Schengen Area) are on the 180 unbroken days regime; I assume that they had their own arrangements with Brazil that predated Schengen and were grandfathered:

  10. Vatican City
  11. Monaco
