Uniao est谩vel - stable relationship

Hello, I'm new in the community I would love if any of you could help me about the "uniao estavel".
I am Italian, my boyfriend is Brazilian, we have been in a relation for already two years.
I want to make my permanent visa for stable realation but I still have a lot of doubt about the process.
We went to the cartorio and registered our uniao estavel, is it enough to initiate the process? As I understood it is not...it's very hard. Anybody did this process lately?

Here is the proceedure to follow.

Request for permanence based on stable union

Request for permanence based on a stable union, requested by a Brazilian or permanent foreigner, who wishes to establish permanent residence in Brazil, as provided for in MJ Ordinance No. 4/2015 and related legislation (RN 108/2014 CNIg):
Application聽 pro prio, available in聽 ;


Two (02) 3x4 size pictures, recent, colorful, with white background. Click here for the guidelines on photography.


Authenticated, clear and complete copy of passport or equivalent travel document;


Certificate of criminal record issued by the country of origin, legalized with the Brazilian consular office in the country in which it was issued, and translated by a public sworn translator in Brazil or in the country of habitual residence of the called party;


A document that demonstrates the existence of a stable union, such as:


The certificate of stable union issued by the competent authority of the country of origin of the call or;

O Proof of a stable bond issued by a competent court in Brazil or a corresponding authority abroad



In the absence of the aforementioned documents, proof of a stable union may be made upon presentation of the following documents:


O The presentation of a certificate or similar document issued by a national civil registration authority, or foreign equivalent;

The declaration, under the penalties of the law, of two persons who attest to the existence of a stable union and, at least, one聽 of the following documents:



O Evidence of dependency issued by a tax authority or a body corresponding to the Federal Revenue Service;

The religious marriage certificate (a minimum of one year will be required for proof)

O Provisions testamentary that prove the bond (it will be required the minimum time of one year for proof);

The Life insurance policy in which one of the interested parties is included as the insurer and the other as the beneficiary (the minimum time of one year will be required for proof);

The Deed of purchase and sale, registered in the Property Registry of Real Estate, in which the interested parties are listed as owners, or lease of immovable property in which they appear as renters (a minimum of one year will be required for proof);

O Joint bank account (a minimum of one year will be required for proof),

The birth certificate of the foreign child of the couple.



Declaration of commitment to maintain, subsistence and exit the national territory, in favor of the call, while the latter remains in Brazil, with a firm recognized in a notary or consular post of career;


Proof of livelihood and financial ability of the caller to sustain the call;


Declaration of the call that was not prosecuted or criminally convicted in Brazil or abroad, with a recognized signature;


Declaration, under the penalties of the law, of the civil status of the calling in the country of origin;


Authenticated copy of the identity document of the caller (Brazilian identity card or alien identity card);


Proof of payment of the respective fee.

Comments:



The documents issued abroad must be legalized by Brazilian consular office and translated by a sworn translator in Brazil.

The documents that must be presented by means of certified copies may alternatively be presented in simple copies accompanied by the original documents for authentication by the public server that receives them, pursuant to聽 搂 1聽 of art. 10聽 of Decree聽 6.932 of August 11, 2009.





Fee Exemption Information:



DECREE N潞 6.771, FEBRUARY 16, 2009: It provides that the citizens of the member countries of the Community of Portuguese Speaking Countries (CPLP), an international organization formed by聽 Angola ,聽 Brazil ,聽 Cape Verde ,聽 Guinea Bissau ,聽 Equatorial Guinea ,聽 Mozambique ,聽 Portugal ,聽 S茫o Tom茅 and Pr铆ncipe聽 and聽 Timor-Leste,聽 are exempt from the payment of fees and emoluments due on the issuance and renewal of residence permits, except for the costs of issuing documents. This means that there is no need to pay the application fee for the extension of the term of temporary visas, stay or registration fee,

Lucyinrio,

I believe your registration paperwork from the Cart贸rio is all you need. If you have that I don't think you need anything from the court. I have not dealt with the stable union process but what I am reading in the list of requirements point to either the registration from the Cart贸rio or the court certificate.聽 Most people opt for marriage because it is easier.

I don't believe you are understanding the requirements. The items you mentioned are needed if you do not have the certificate from the Cart贸rio.聽 聽Here is a better explaination of what is needed.

Sometimes, including in Brazil, you need to be careful what you ask for.聽 聽Permanent residency by way of stable union may not be all that "permanent."聽 Also you should take a look at the original text of the administrative resolution, and not just a summary, even it appears on a government web site.

For instance in Article 9 of the Resolution referred to earlier,

Do you really want to go through this much more convoluted process by stable union and then have to reapply and go through it again?

I had originally聽 been聽 looking聽 at聽 stable聽 union聽 myself.聽 As a friend did did聽 it聽 and said聽 it was聽 easy, she stayed聽 illegally聽 though. But i have聽 heard聽 and聽 read Stable聽 Union聽 can be聽 time聽 consuming聽 and聽 not always聽 easy.聽 聽Due聽 to some聽 issues聽 i actually聽 聽ended聽 uo going聽 through聽 a lawyer聽 and聽 they said聽 as a few聽 others did聽 also聽 that Marraige聽 was聽 easier聽 and better. I'm聽 聽returning聽 to Brazil聽 next week.聽 聽I went聽 back聽 to聽 UK to see family聽 and聽 sort聽 things.聽 Police聽 Check聽 etc聽 abd doing聽 it at consulate聽 was聽 nice聽 and quick.


One thing聽 I will say聽 is that.聽 Is if your passport聽 聽has only聽 a year聽 or聽 two聽 left聽 on it (mine聽 had聽 15 months)聽 get聽 it renewed聽 before聽 you apply聽 for Viper.聽 聽 As they do not聽 transfer聽 it聽 to new聽 passport,聽 聽so聽 it means聽 you would聽 have聽 too carry聽 two聽 passports (or certified聽 copies)聽 聽around聽 with聽 you as proof.

Update with regards to my visit to the register on Friday. I was able to get great information and also was able to get a CPF number with my passport. The only issue that they had was my birth certificate had been translated in November 2016 and they say it needs to be more resent.
So I had to go an get it recertified. Just alot of time needed for everything.
Plan to spend the day running around because all the offices are not close. They are all downtown.

Hello All,
I made Uniao Estavel with my Brazilian boyfriend in Cartorio. I needed just my international passport and translated Birth Certificate.
I will start the proccess of permanencia next month and will write you my results..maybe it will be helpful for someone..

Hi all I have completed the stable union application.

Process:
As stated above, you will need to have you birth certificate no more than 180 old
Translated in Brazil
Apply for a CPF number
2 witnesses
And you are done

Note that this is not marriage but for those that know about common law in North America. It's the same thing.

Note that the process for permanent residency is very long with stable union. Much shorter with the marriage route

Yes, people should be ready for the long process in Policia Federal..
As for documents in cartorio, I would advise to go to different cartorios and ask list of documents for uniao estavel. I was in two cartorios and they gave me different lists of docs.. So I chose the one where I needed less docs聽 - international passport and translated birth certificate. They checked if I can do it without CPF, and did Uniao estavel without it.

Hi guys,

Great, useful information here. However I still have some queries.

I'm comfortable with the stable union application process. Call a few cartorio's, and ask what documents they need:

Grab my girlfriend and two witness, along with passport
Apostilled birth certificate, translated in Brazil
Maybe CPF ( I'll get this anyway when I arrive)

However I will be arriving on a tourist visa, which obviously expires after 90 days, or 180 extended. I've done research and some places say you can only apply for permanent residency on stable union after living in Brazil for one year - is this the case? Will the stable union allow me to stay in Brazil?

Correct, the process for permanent residency with a stable union is long because it is not a marriage.
It's a stable union for legal purposes

It all depends on when your visa ends. I would apply as soon as possible and you will get a protocol 180 day as you are going the process as was stated on the forums. But the key is you must wait 1 year with stable union.
You need to go on the police federal website. All the information is there and how long it takes

I can stay in Brazil on a tourist viza for 6 months. I made Uniao Estavel and will give docs to Policia Federal for permanencia on my 7th month in Brazil. They told me 6 months of Uniao Estavel is OK...when I give the docs to PF, I will update my story here :)

Wow, it doesn't make sense that you will summit you documents on the 7th month when you are here illegally. Also when were told that you can apply after being in a stable union for only 6 months instead of 1 year?

Last week I was in Policia Federal and they told me this.. They told me I can give docs for permanencia when I am already illegal, just need to pay the fine for these "illegal' days.
I am in Brazil for 6 months now so I couldn't put the date of Uniao Estavel earlier than this time of 6 months..because before I was in another country.

Yes. Due to getting a date after I was supposed to be leaving the country. They said that I could not put my application in. However I got a protocol to go across any country next to Brazil to just get a stamp in my passport with the next 10 days and then it will be ok. So I am going to Argentina, cheaper flights for 1 day.

I got my permanencia!!! As I saw, it depends a lot on the city where you will apply for it. In smaller cities it is a little easier.

Not only small cities. I got my residency in less than 2 months and I am in BH.

I think it's all about your pass and your partner, etc

I mean comparing with Rio. In Rio it was a a little more complicated, officers everytime said something new and found many "mistakes" in the documents..

If you are talking about the document for PF = DECLARA脟脙O DA TESTEMUNHA DE UNI脙O EST脕VEL, then, unfortunately, yes, they need to come to cartorio.聽 Show this document and ask this in your cartorio, to be sure..

An update from me. I wasnt able to apply for permanancia here in belo horizonte because despite having the stable union certificate from the cartorio, we had no other proof of living together over a year.

They require either the stable union document to be a year old, or two other documents over a year old with both of our names.

Hey everybody this post was very helpful聽 I'm in Floripa too and going through the process with my girlfriend (from the U.S.).聽 I only have a few days before my visa expires.

I'm running into a few obstacles in the process that this post didn't run into. All the cart贸rios I call are asking for:

-- Certid茫o de Estado Civil
-- Certid茫o de Nascimento (that was created/ validated in the last 120 days)

I know Saint9711 mentioned the birth certificate 120 day validity thing, but I wasn't expecting that.

Any other perspectives on how (or where) to circumvent these 2 problems?
